This Site is operated by VB Cosmetics, Inc. Throughout the Site, the terms “we”, “us” and “our” refer to VB Cosmetics, Inc. VB Cosmetics, Inc. offers this Site, including all information, tools, products, and services available from this Site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here (“Terms of Service” or “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service and Privacy Policy apply to all users of the Site, including without limitation, users who are browsers, vendors, customers, merchants, and/ or contributors of content. SECTION 1 - MODIFICATIONS TO THE SITE AND PRICES
Occasionally there may be incorrect information on our Site, such as typographical errors, inaccuracies or omissions, which may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability. We reserve the right to correct any incorrect information, and to change or update information or cancel orders if any information on the Site is incorrect, at any time without prior notice (including after you have submitted a purchase order). Prices for our products or services are subject to change without notice. We are not liable for any modification, price change, suspension or discontinuance of the Site.

SECTION 2 – PRODUCTS, SERVICES, AND LIMITATIONS ON RESALE
Certain products or services may be available exclusively online through the Site. These products or services may have limited quantities and are subject to return or exchange only, according to our Return Policy. We have made every effort to display as accurately as possible the colors and images of our products that appear on the Site. We cannot guarantee that your computer monitor's display of any color will be accurate. We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. All descriptions of products, services, or pricing are subject to change at any time without notice. We reserve the right to discontinue any product or service at any time. Any offer for any product or service made on this Site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations.

This Site is solely for retail sales, and products purchased here are intended to be only for personal use or as gifts from the purchaser to another individual. Products purchased here may not be resold in a store, salon, or online. You are expressly prohibited from using the term DAZZLE DRY or VB COSMETICS for any resale of products.

SECTION 3 – ORDERS AND RETURNS
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. SECTION 4 – YOUR ACCOUNT; ACCURACY OF BILLING AND ACCOUNT INFORMATION
You represent that you (a) have not previously been suspended or removed from the Site, (b) you will only provide us with true, accurate, current and complete information if you register for an account and/or purchases (defined below), (c) you will provide current, complete, and accurate purchase and account information for all purchases made at our Site, and (d) you will promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.If we believe or suspect that your information is not true, accurate, or complete, we may deny your access to the Site (or any portion thereof).

Privacy Policy

SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION
When you browse our Site, we automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system. When you purchase something from our Site, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address. With your permission, we may send you emails about our Site, new products and other updates.

We may disclose your personal information if (a) we are required by law, (b) in any dispute between you and us, or (c) if you violate this Privacy Policy or the Terms of Service.

SECTION 5 – SHOPIFY & SECURITY
Our on-line store on the Site is hosted on Shopify Inc. Shopify provides us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify’s data storage, databases and the general Shopify application. Shopify stores your data on a secure server behind a firewall. Shopify’s compliance covers all six PCI standard categories: maintain a secure network, protect cardholder data, maintain a vulnerability management program, implement strong access control, regularly monitor and test networks and maintain information security policy. Payment

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. The data is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After your purchase transaction is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council. PCI-DSS requirements help ensure the secure handling of credit card information by our Site and its service providers. SECTION 6 - THIRD-PARTY SERVICES

SECTION 7 - COOKIES
Here is a list of cookies that we use. You can choose, if you want, to opt-out of the cookies
._session_id, unique token, sessional. This allows Shopify to store information about your session (referrer, landing page, etc).
_shopify_visit, no data held, persistent for 30 minutes from the last visit. This is used by our Site provider’s internal stats tracker to record the number of visits.

_shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day. This counts the number of visits to the store on the Site by a single customer.
cart, unique token, persistent for 2 weeks. This stores information about the contents of your cart.

_secure_session_id, unique token, sessional storefront digest, unique token, indefinite. This is used if a shop on the Site has a password, in which case this determines if the current visitor has a password to access that shop.

For any states or jurisdictions that do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

SECTION 5 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless VB Cosmetics, Inc. and its subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service, Privacy Policy or the documents or terms they incorporate by reference, or your violation of any law or the rights of a third party.

SECTION 6 - SEVERABILITY
In the event that any provision of these Terms of Service or Privacy Policy is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from the Terms of Service or Privacy Policy, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 7 – INTELLECTUAL PROPERTY RIGHTS
The Site, and all of its contents, including text, photographs, designs, layout, images, graphics, videos, audio, software, trademarks, service marks, logos, excluding comments or other user content, is protected by copyright, trademark and other laws of the United States, as well as international conventions and the laws of other countries. The Site, its contents, and its intellectual property are owned by VB Cosmetics, Inc.Except as otherwise provided in these Terms of Service, you may not directly or indirectly, use, publish, reproduce, display, create derivative works from, reverse engineer, copy, post, save, transmit or modify the Site or any portion thereof.  Nor will you use any trademark, service mark, or logo appearing on the Site. 

SECTION 8 – CLAIMS REGARDING COPYRIGHT INFRINGEMENT
If you are a copyright owner or authorized agent and believe that any content on the Site infringes your copyright or trademark, you may submit a notification pursuant to the Digital Millennium Copyright Act (“DMCA”) by providing us with the following information in writing: (a) a physical or electronic signature of the owner or a person authorized to act on behalf of the owner of an exclusive right that is purportedly infringed; (b) identification of the work alleged to have been infringed; (c) identification of the material that is allegedly infringing, and information sufficient for us to locate the material; (d) your name, address, telephone number, and email address; (e) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or trademark owner, its agent, or the law; and (f) a statement, under penalty of perjury, that all the information in the notification is accurate and that you are, or are authorized to act on behalf of, the owner of an exclusive right that is allegedly infringed.  Any such notice should be emailed to us at legal@vbcosmetics.com.
After receiving a claim of infringement, we will process and investigate the claim and will take appropriate actions under the DMCA and other applicable intellectual property laws. 

 SECTION 9 – TERMINATION WITH OR WITHOUT CAUSE
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service or Privacy Policy, we may terminate this agreement without notice, and you will remain liable for all amounts due up to and including the date of termination.

We may also terminate or suspend your access to the Site, delete your profile and any content or information that you have posted on the Site and/or prohibit you from using or accessing the Site (or any portion, aspect or feature of the Site) for any reason, or no reason, at any time in our sole discretion, with or without notice to you, effective immediately, which may result in the forfeiture and destruction of all information associated with you and your activities in connection with the Site.  If you wish to terminate your account, you may do so by following the instructions on the Site. In the event of termination, you will still be bound by your obligations under these Terms of Service and Privacy Policy.

Any dispute regarding these Terms of Service or Privacy Policy shall be venued exclusively in a state or federal court located in Maricopa County, Arizona. You consent to the jurisdiction of these courts with respect to any such dispute.
